Protos Select Application Privacy Policy

This Privacy Policy (“Policy”) applies to all information received by Single Source Security, LLC d/b/a Protos Security and its affiliates under common ownership or control (collectively, “Protos”) through Protos’ Protos Select software application (the “Platform”), whether reached through a mobile application, a web browser, a personal computer or any other means.

This Policy applies to persons anywhere in the world (collectively, “Users”) who interact with the Platform for any reason. Users include, without limitation, Protos’ third-party vendors who utilize the Platform in connection with services provided pursuant to their agreements with Protos (“Security Provider Vendor Users”), as well as the security guards and off duty and retired law enforcement officers (collectively, “Security Personnel Users”) who utilize the Platform to schedule security services, enter geofenced mobile time punches and engage in other activities approved by Protos, all in connection with the security services that Protos provides to its customers (the “Protos Services”).

What Personal Information do we collect?

Protos collects Personal Information about you when you interact with the Platform or otherwise communicate with us. Personal Information may include your name, telephone number, email address, date of birth, home address, business address, mailing address, Social Security number, Employer Identification Number (EIN), W-9 information, transaction information and usage and preference information (collectively, “Personal Information”). 

Personal Information may also include:

  • Transaction Information:Protos may collect your payment account information (g., sensitive card information or other account information) through a third-party website or application linked through the Platform (“Third-Party Portal”) for purposes of processing and completing payment in connection with services you may provide directly or indirectly on behalf of Protos in furtherance of the Protos Services. By using the Third-Party Portal, you agree to any terms and conditions, privacy policy, or other agreement applicable to users of the Third-Party Portal. You expressly agree that any data or information you provide over the Third-Party Portal may be shared with Protos or its affiliates. Protos is not liable for the actions or omissions of any third party, including any third party involved in providing the Third-Party Portal. For the avoidance of doubt, your entry of payment account information does not entitle you directly or indirectly to any compensation or other form of payment. Your right to compensation, if any, in connection with any Protos Services shall be set forth in a separate agreement authorized by Protos.
  • Geolocation Data: Protos collects IP address and geolocation data from Security Personnel Users in connection with their entry of geofenced mobile time punches and to track their location while engaged in the Protos Services.
  • Usage and Preference Information: Protos may automatically collect information about how you interact with the Platform. For example, we may aggregate information about you and other Users who use the Platform. The information may include a browser type and browser plugins, search engine keywords, JavaScript enablement, internet service provider (ISP), referring/exit pages, operating system software, screen resolutions and screen color capabilities. Aggregated information will not contain any information that can be linked directly back to you.
  • Log Information: When you interact with the Platform, Protos automatically collects information from server logs, which may include Personal Information such as device IP addresses and access dates and times.

How do we collect your Personal Information?

Protos collects Personal Information that you provide directly to us when you:

  • submit a form on the Platform;
  • register or modify a user account;
  • request security services;
  • contact customer support or Protos with any inquiries, including via email;
  • enter a mobile time punch over the Platform; or,
  • otherwise voluntarily provide information.

Protos also uses tools to automatically collect information about you and your visit to the Platform, including, but not limited to, traffic data, IP address, date and time you accessed or left the Platform, usage and preference information, log information, geolocation data and the web browser that you use to connect to the Platform.

Use of cookies

We use and allow certain trusted partners to use cookies, web beacons, and similar tracking technologies (collectively, “cookies”) on the Platform. Cookies are small amounts of data that are stored on your browser, device, communication, or the page you are viewing. Some cookies are deleted once you close your browser while other cookies are retained even after you close your browser so that you can be recognized when you return to a website. The Platform may also use web beacons. Web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) are small electronic files that permit us, for example, to count Users who have visited pages on the Platform and for other related website statistics.

We use cookies to provide the Platform and to gather information about your usage patterns when you navigate the Platform to enhance your personalized experience and to understand usage patterns to improve the Platform. Most browsers accept cookies automatically. You may be able to set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. For instructions, check your browser’s technical information. If you disable or refuse cookies, please note that some parts of the Platform may then be inaccessible or not function properly.  Please note that cookie-based opt outs must be performed on each device and browser that you wish to have opted out.

How do we use your Personal Information?

  • Protos uses your Personal Information to contact you via mail, e-mail, or telephone in connection with the Protos Services or your use of the Platform and to respond to any communication that we receive from you.
  • Protos uses your IP address to help protect Protos and our Internet Service Providers from fraud.
  • Protos uses your Personal Information to personalize your experience and to perform analytics to learn about the behavior of our Users or otherwise improve our Platform.
  • Protos may use your Personal Information to assess or exercise a legal right or to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding in which Personal Information held by us about our Users is among the assets transferred.
  • Protos uses your IP address and geolocation data to record mobile time punches and to track your location while you are engaged in any Protos Services. Protos may convey the foregoing information to its customers and Service Provider Vendors in connection with the Protos Services. By using the Platform, each Security Personnel User expressly consents to the foregoing processing and sharing of location-based data.
  • Protos uses your Personal Information to provide services to its customers.

Protos will provide you with the choice and means for limiting the use and disclosure of your Personal Information before Protos uses or discloses the Personal Information for a purpose other than for which it was originally collected.

Disclosure of your Personal Information to third parties

Protos will never sell your Personal Information to any third party.

Protos may disclose your Personal Information as follows:

  • to affiliates, contractors, service providers and other third parties we use to support our business and/or the Protos Services.
  • to Protos’ customers and contractors in connection with the provision of services, including without limitation providing geolocation and other data concerning Security Personnel Users to Protos’ customers and Security Provider Vendor Users in connection with the Protos Services.
  • to any third party for any purpose disclosed by us when you provide the information or if we reasonably believe disclosure is necessary or appropriate to protect the rights, property, or safety of Protos or others.

Protos may share Personal Information with its affiliated businesses where appropriate in furtherance of Protos’ legitimate business purpose. Such sharing between affiliated businesses is never done for marketing/advertising purposes. Protos also may disclose your Personal Information as is necessary to: (a) comply with a subpoena or court order; (b) cooperate with law enforcement or other government agencies; (c) establish or exercise our legal rights; (d) protect the property or safety of Protos employees, contractors, vendors, affiliates and Users; (e) defend against legal claims; (f) help with internal and external security investigations; and, (g) as otherwise required by law or permitted by law. Protos may disclose your Personal Information in connection with any transaction that involves the sale or assignment of some or all of Protos’ assets to a successor business where the original purposes for use of your Personal Information remain the same. If the business successor desires to collect and use your Personal Information for other purposes, it will provide you with an updated notice of those purposes.

How long will we retain your Personal Information?

We do not retain your Personal Information longer than is necessary, taking into account any legal obligations we may have (e.g., to maintain records for tax purposes, to comply with contract terms). If you would like to have your Personal Information deleted once you no longer want to use our services, please submit a request in writing to help@protossecurity.com.

Your Choices

We strive to provide you with choices regarding the Personal Information you provide to us. We created mechanisms to provide you with the following control over your information: (a) You may review, edit or request that we delete the information we collected about you at any time by contacting us at the addresses listed at the end of this Privacy Policy. (b) If your information was shared with a third party, as described elsewhere in this Privacy Policy, then that third party received its own copy of your data. (c) If you were contacted by one of these third parties and wish to correct or delete your information, please contact them directly.

“Do Not Track” Requests

The Platform currently does not respond to “do not track” or similar signals.

How do we secure your Personal Information?

No method of securing information over the Internet, mobile app, or method of electronic storage, is 100% secure; therefore, we cannot guarantee the absolute security of any Personal Information. However, in securing Personal Information, we utilize reasonable, generally-accepted technical and organizational security measures to protect your Personal Information against loss, misuse, or alteration throughout collection, transmission, processing and storage, including the physical security of our facilities. Your transmission of your Personal Information to our Platform is done entirely at your own risk.

Children’s Information

Content on the Platform is not intended to be directed towards children who are under the age of 18. We do not knowingly collect information from children under the age of 18. If Protos becomes aware that a child has provided Personal Information without parental consent, that Personal Information will be deleted from our databases. If you have reason to believe that we collected or are in possession of Personal Information from someone under 18 years of age, please contact us at help@protossecurity.com.

Links

We may provide external links to third-party sites as a benefit to you and other Users. We have no control over the content of any third-party sites. Therefore, we are not responsible for any information contained on these sites. Also, we are not responsible for the privacy policies of these sites and the information they may gather. We urge you to review the privacy policy of any site that you visit before providing your Personal Information.

International Visitors

The Platform is hosted and operated in the United States (“US”). By using the Platform, you are consenting to the transfer of your Personal Information to the US. If you are accessing the Platform from outside the US, please be advised that US law may not offer the same privacy protections as the law of your jurisdiction.

Special Notice to California Residents

In accordance with California Civil Code Section 1789.3, California residents are entitled to know that they may file grievances and complaints with California Department of Consumer Affairs, 400 R Street, Ste 1080, Sacramento, CA 95814; or by phone at 916-445-1254 or 800-952-5210; or by e-mail to dca@dca.ca.gov.

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits Users of the Platform who are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Updates and Contact

We may revise this Policy from time to time, and we encourage you to periodically review this Policy for the latest information on our privacy practices. If Protos makes significant changes in the way we treat your Personal Information, or to this Policy, we will provide you with notice through the Platform, or by some other means, such as e-mail. Your continued use of the Platform after such notice constitutes consent to those changes.
